1. Acceptance of Terms

By accessing or using Kykis ("the Platform", "we", "us", or "our") at kykis.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Platform.

We reserve the right to revise these terms at any time. We will notify registered users of material changes via email. Continued use of the Platform after changes constitutes acceptance of the revised terms.

2. Eligibility

You must be at least 18 years of age to use this Platform. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

Kykis is a marketplace platform. We do not ourselves buy, sell, or own any watches listed on the Platform. All transactions are solely between buyers and sellers.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Provide accurate, complete, and up-to-date registration information.
  • Not share your account with any third party.
  • Notify us immediately of any unauthorised use of your account at legal@kykis.com.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, to be harmful to the Platform or other users.

4. Listings & Seller Obligations

Sellers on Kykis must ensure that all listings are:

  • Accurate: All descriptions, photographs, reference numbers, and condition ratings must truthfully represent the item.
  • Authentic: Listing counterfeit, replica, or misrepresented items is strictly prohibited and will result in immediate account termination and potential legal action.
  • Legal: You must be the lawful owner of any item you list or have the explicit authority to sell it.
  • Compliant: Listings must comply with all applicable UK and international laws.

All listings are subject to moderation and may be rejected or removed at our discretion without notice.

5. Subscription Plans

Seller accounts are subject to subscription tier limits on active listings. Subscription fees are charged in advance and are non-refundable unless required by applicable law.

We reserve the right to modify subscription pricing with 30 days' notice to active subscribers. Cancellation takes effect at the end of your current billing period.

6. Prohibited Conduct

You agree not to:

  • Post fraudulent, misleading, or deceptive listings.
  • Harass, threaten, or abuse other users through the messaging system.
  • Attempt to circumvent Platform fees or conduct transactions off-platform to evade our policies.
  • Use automated bots, scrapers, or data-mining tools without prior written consent.
  • Upload malware, viruses, or any code designed to disrupt the Platform.
  • Engage in any activity that violates the rights of third parties, including intellectual property rights.

7. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

We make no warranties regarding the accuracy, completeness, or authenticity of any listings or user content on the Platform.

8. Limitation of Liability

To the fullest extent permitted by law, Kykis and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Platform or any listings thereon.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to Kykis in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
